Supreme Court Upholds 7-Year Sentence for Yoon Seok-Yeol in Arrest Hinderance Case

According to Yonhap News, on the afternoon of July 9 local time, the Supreme Court of South Korea ruled in the case of former President Yoon Suk-yeol being suspected of hindering arrests following the emergency martial law situation. The court upheld the sentence of 7 years in prison handed down in the second instance.

On the evening of December 3, 2024, Yin Xiyue issued an emergency martial law order. The next morning, the South Korean National Assembly passed a resolution calling for the cancellation of the martial law order. Subsequently, Yin Xiyue was suspended from her duties, arrested, and impeached. In early 2025, Yin Xiyue used the presidential security department to obstruct agencies such as the South Korean Public Officials Crimes Investigation Agency from arresting her, leading to accusations of hindering arrests.

In January 2026, the Seoul Central District Court conducted a first-instance judgment in this case, sentencing Yoon Seok-yeop to 5 years in prison. In April, the Seoul High Court issued a second-instance judgment, sentencing Yoon Seok-yeop to 7 years in prison.

This is the first third-instance judgment handed down by the Supreme Court of South Korea in a judicial case involving several emergency martial law incidents involving Yoon Suk-yeol. According to Yonhap, Yoon Suk-yeol faces a total of eight trials.
